I really doubt whether any attorney knows how many total VISAS are there for EB1 + EB2 for the fiscal year 2008. On this total EB1 + EB2 we got an estimation based on our calculations in our privious posts.

From Zhang (http://www.hooyou.com/news/news011307bulletin.html):
We suspect that the large number of approved cases in BEC have a big impact on the progress of Visa Bulletins. Department of Labor announced on December 11 that the BEC then had 142,418 cases pending, while in September, the pending case number was 176,000. In the past three months, about 33,600 cases have been removed, with a pace of 11,000/month. Then, the number of I-140 & I-485 petitions soared up in the past several months. This fact stalls visa bulletins in department of state. We predict that it is hard to see a big progress in visa bulletin, given the hope that BEC will keep its current pace of processing cases. However, we don?t expect to see a big retrogression of visa bulletin in the next a few months either. Things may change in the second half of 2007.

Dear Attorney,
I am about to file my I140.
I am in the US on L1B with company A and my GC is for future employment with Company B.
The unknown for me is that when my dates become current, I might be in my home country after completing my US assignment or in another assignment in the US itself.
In this case what is my best option, AOS or CP?
Can I choose CP now and if I am in the US when my dates are current, switch to AOS quickly and still file my I485?
Looking forward to your guidance. Thanks a ton!!

You Moron...open your Freaking eyes and read all the posts here. No one is supporting the LTTE. Why do you deviate from the topic again and again. We are talking about the civilians getting killed...but your freaking mind things and talks only about LTTE.
dude if u have no arguments, stop from calling names. i am not the one to be riled by intenet name calling. it is no bravery.
See my other posts and you will clearly see i have said that civilians need to be protected whether they are in darfur, kosovo or lanka. and i was replying to this particular person who was claiming
<i>It is Indian gov. lobbied efforts to ban LTTE by western country. they are well organized, disciplined and high tech group. some people raise another issue, they recruited young children to fight,</i>
this guy is clearly condoning LTTE. Dude either you get a pair of glasses or get some arguments with logic and yeah calling someone moron is not an argument.

The US Constitution is a very concise document. Here is a link to it.
http://www.usconstitution.net/const.html
I don't think that per-country caps on immigration are unconstitutional. Please note that I am affected by this and would be very happy if the caps are lifted, but I do not think that this approach is viable and that this is the best use of our limited resources.
I also disagree with your premise that corporations want to see the caps lifted.
we, as non citizens, obviously do not have all the rights that the citizens possess. We don't know whether this rule is or is not constitutional (And as someone rightly pointed out that the expertise of a constitutional attorney is required).
However if it can be shown that certain citizens/corporations ( for example microsoft, google etc who also make efforts and lobby congress to change the law ) are unduly disadvantaged by this per country cap, then they can be plaintiff. So in a sense, we have allies in the corporate sector with tons of money (and who want to make more!) So they might be willing to support us,
if it is indeed found that the rule can be challenged.

Very nice thinking..high thinking as long as you don't want to start applying this yardstick only on Modi and end it there. If we start applying no criminal background yardstick then no politician from the current brigade will be left(assuming when you say criminal background you mean all kinds of crimes)
In other words you are sitting on 6 th floor and Indian political scenario(to that matter political scenario else where too.e.g U.S) is on ground floor.
Let's start doing our best so we can get the ground floor to meet 6th floor.
Till they two meet let's work on 'every sinner has a future, every saint has a past'
Just so you know Obama was into drugs in teens. Wouldn't it be a loss if we applied your yardstick on him ?
Although you said you are not supporting any one of them since you kind of endorsed MMS in previous posts think about this
which one is evil of the two : a guy accused of committing crime in the past but who got his act together and is giving good performance or a Intelligent guy knowing full well he wouldn't wield any power accepting to be a show piece/wrapper PM and taking billion people on a ride?
I am not defending any party or person. Everybody is equally bad. Let, all the Muslims in Gujarat may start love him, and entire Gujarat may vote for him. That does not matter. My point is that those people who run for high office should not have any criminal background, despite how much qualified or skilled they are. Assume, if you involved in small domestic violence, and if you fail in small background check you will not get GC even if you are a Nobel Prize winner. Think about PM post and its responsibilities.

for people who want to invest, there is a investor visa(gc). The limit of investment is little higher though, so only few out of the current EB line will get out. Yes line will get shorter.
I dont think buying a greencard for 100,000$ or for any money is wise. You already are paying enough taxes, paying legal fees.... and of course spending ur prime here waiting for a permanent resident status.
So let them grant GCs if they feel like. Dont bribe ur way in!!
Also if one bought a home and then got a GC, lets say he sold the home right after... what abt it....!!

You have got the same Indian mentality that most of the people here that once we got a GC and citizenship let us close the doors behind us.
....
Who are you to judge the people coming after you that they are not skilled or the best and brightest.
Well he is a permanent resident of US and soon to be USC and majority of US citizens
want reduced immigration to US and can vote in elections accordingly.
Immigration is such a hot topic I dont see Obama doing anything before his second term.

Guys : Once again I would suggest not to use tunnel vision. I personally know one case of EB1 in cognizant where one of my closest friends who never scored more than me in college exams and doesnt make more than I do got his GC in EB1.
Whatever Mr Oppenheim is saying is precise bullshit! Its all political. He is a bureaucrat who needs to defend the political policies. Where have we seen any transparency? Is there any transparency to the whole process?
If Mr Oppenheim has numbers so handy, can he explain why there are wild swings in visa bulletin and not a computerized FIFO policy. I can understand some 15-20% overlap for cases stuck in name check, unapprovable, etc etc. But every month/year visa bulletin swings like a pendulum which doesnt know which way is the right way.
If you complain about EB1, your friends will also lose GCs and no body will get GC. With that you are effectively saying, I dont get GC, even X should not get GC.
Although I think EB1 problem is largely restricted to Cognizant and needs to be addressed.

The VIP culture and the sense of entitlement in India is sickening  I would understand if George Fernandes had raised a fuss since he was travelling as a diplomat, but SRK is pure dung!! FFS, he is there only to promote his movie - like some one mentioned here, the world doesnt come to an end if he is delayed by an hour or if the movie flops or doesnt even see the light of day.
You nailed it brother! SRK is just another moron who thinks he owns the world! All things being equal, there is no reason for him to get any special treatment at all -- he is no diplomat or a guest of this country. If there was something wrong with his luggage and/or profile that made the CBP flag him and question him, I don't see anything wrong with that. I can't agree more with you on the stupid "VIP" culture that sits deep in the roots of these glorified-beyond-reality idiots.
And then there are people here comparing India and the US...what the heck! This is America and they can do whatever they like to keep it safe...who are we to say that our "star" deserves better treatment when they don't spare their own people?:rolleyes:

You've got to be high or sick or both - go see a doctor. Right now you're just throwing trash around.
great so you're trying to incite arguments between members and calling people names. you just proved my point. well don't waste time making empty threats or inciting people on forums.
You can take your trash somewhere else.
If you had any ideas you should have talked to your IV state rep in the last 4 years, it doesn't matter what you post.

Current homeowners who are waiting for their GC MUST also be exempted from cap. This clause has to be there. Without having any gurantee of getting GC these folks have invested their savings in buying home even when the prices were high, WHY because they had real intent of making US their permanent home. So these people should too be exempted from EB cap.
A better justification would be that doing so will avoid bringing new supply on the market from people moving to their native countries.
FWIW, the home I bought in 2001 is paid off, but I wouldn't mind buying another one if this comes through.

Thank you for your personal opinion. India was doing well when Vajpayee was PM. He is not some management honcho. It is a vision of the person that is more important. Manmohan is a learned man and has provided country with real good service but real power rests with Sonia and her son Rahul.
Hence. Its a question of ideology in the long run and given my background, BJP govt suits me better than Congress. So I prefer Advani over Sonia.
I am not sure what vision Mr.Advani has for India. May be at this age he might have better vision than other people in the same league.

These morons never learn lessons. He is insulting him self by bitching about it....the Officers are just doing their job to verify their system... Can you imagine that a foreigner coming to India might have to go through ordeal if Indian Official suspects that he is a terrorist just because his records show....He should not forget that US has such system to verify and let him go.... where is SRK and others showing some passion when similar thing happen to President Abul Kalam? where is SRK and others showing some passion when bombings happened and innocent people get killed time and time again in India. Did he called for such system in India??? Where is SRK and others showing some passion that we need to improve Education System so that we can be proud of as Indians again? These guys thinks every thing for me nothing for others. They got all the money in the world they want.. now what?? how much is enough for these guys....People like him should learn life lessons like this and try to change Indian peoples life so that they get respect around the world. I think that is better for all of us. As Indians we should teach them or remind them when they forget those values.
Lets not bash or blame SRK for what he said or did. You are now blaming him for all the problems in India.
For India's problems - "All Indians are equally responsible". For world's problems " All people in the world are equally responsible"
"The world is a dangerous place to live; not because of the people who are evil, but because of the people who don't do anything about it." -

You can paint it with any emotion but it still is the fact.
It is no diferent from the wat India dealt with extremism in Punjab.Until KPSGill stepped in,it kept raging. It is same as the way India trying to deal with Kashmir.
I am a non-immigrant in USA,sure. If I try to demand and bear arms to get a separate country here, definitely my life will be in danger.Should I expect India to come to my rescue?
Being a NRI in US, your conclusion is it is a SL issue, not a India issue. This is because you enjoy freedom, safety and opportunity in USA, even though you are just a non-immigrant in USA. Hope it will continue. If your job, safety, security, life becomes danger here, then do not get help from India or Indian consulate in USA; because it is a "US issue" as per your logic.

This is actually a pretty good argument/statistic. However; it isn't specific to employment base but rather to worldwide level of immigration from all sources.
In my opinion, it is more relevant to EB immigration....To support a higher number of benefit recipient you need a higher number of EB immigrant who are more likely to be productive that FB immigrants.....
Now that is equivalent of passing judgment on FB immigrants as being unproductive.....I know I am going to get flak on that...
